LIABILITY DAMAGE WAIVER - RENTAL PROTECTION PLAN COVERAGE

• 1. An instrument totally destroyed by fire or other cause, or an instrument that is lost, will be replaced by the Company without charge with an instrument of similar or equal brand, age, and condition. The Company may require reasonable proof of any such loss or destruction. The Company will replace a stolen instrument provided the Customer reports the theft to police within twenty-four (24) hours after discovery of the theft.
• 2. If the instrument becomes damaged or deteriorates in performance, the Company will repair and return it to proper playing condition without charge. This offer does not apply to the deterioration of appearance such as scratches, minor dents, or deteriorated finish as they do not affect the overall playing performance of the instrument. The Company will not repair or replace any instrument that is determined to have been damaged intentionally.
• 3. Specifically excluded from this plan are drum heads, drum sticks, strings, reeds, lubricants, lost minor parts, and special or custom equipment.
• 4. All repairs and replacements under this agreement must be made by the Company.
• 5. Any claim for repair or replacement under this agreement shall not be construed to alter or diminish the terms of the accompanying Rental Purchase Agree ment. If the Lessee defaults in any payment of the Rental Purchase Agreement, this Liability Damage Waiver will lapse by default. It may only be reinstated by the expressed permission of the Company.
